Provide a responsible service I am writing to you from the Market Surveillance Unit within the Driver and Vehicle Standards Agency (DVSA).
The Market Surveillance Unit (MSU) ensures vehicles, parts, accessories and modification services in the UK automotive market comply with the relevant regulations, and meet legal requirements. It conducts enforcement action on behalf of the Department for Transport relating to type approval and legislative requirements connected with vehicles, services and components, in respect of the manufacturers, suppliers and distributors of these. We conduct broad market surveillance into businesses offering services to supply and fit window tints. Regulations specify that the nearside and offside front door windows, for which the driver uses for forward vision and when using external rear facing mirrors, must permit a light transmittance value of at least 70% (for motor vehicles first used on or after 1st April 1985), with the front windscreen permitting a light transmittance value of 75%. Under the Road Vehicles (Construction and Use) Regulations 1986 (Section 32) and the Road Traffic Act 1988 (Section 76), it is an offence to (a) fit a vehicle part to a vehicle, or (b) cause or permit a vehicle part to be fitted to a vehicle in such circumstances that the use of the vehicle on a road would, by reason of that part being fitted to the vehicle involve a danger of injury to any person or, constitute a contravention of or failure to comply with any of the construction and use requirements. During broad surveillance caried out to obtain the publicly available services being offered, NE Tints has been identified as offering services to supply and fit window tints for use on a road in Great Britain Businesses providing services to modify vehicles have an obligation under The Road Traffic Act 1988 and The Road Vehicles (Construction and Use) Regulations 1986 to ensure that the vehicle modifications being offered and carried out are lawful and do not contravene the aforementioned regulations. All services offered must be clear. Under The Consumer Protection from Unfair Trading Regulations 2008, suppliers must not mislead customers by leaving out important information or by including false or deceptive messages. There is a general obligation for traders to give consumers sufficient information about goods and services at the point of sale, so consumers are not misled. The regulations ban commercial practices through which omissions and actions cause, or are likely to cause, the average consumer to make a decision they would otherwise not make for example, to purchase goods or a service that they would otherwise not have purchased. The consumer regulations carry criminal penalties and are enforced by local authority trading standards officers. Therefore, all advertisements for window tint supplies and / or window tint fitting services MUST include guidance for consumers surrounding the legal minimum light transmittance values for motor vehicles, making it clear that factory fitted windows are already tinted and by adding additional tinting, this may result in vehicles no longer being compliant for road use. We advise you make the following changes to ensure you are compliant · advertisements for vehicle modifications MUST include guidance for consumers surrounding the legal use, · making it clear that it is an offence to alter a vehicle in such a way that the use of the vehicle on a road would be unlawful. We would like to remind you that failure to comply with the regulations may result in prosecution. A person who supplies and fits a vehicle part to a vehicle, or causes or permits a vehicle part to be supplied or fitted to a vehicle, in contravention of these the construction and use regulations, is guilty of an offence and is liable on summary conviction to a fine not exceeding level 5 on the standard scale.
